Parole board plan to consider life sentences


THE LEGAL Service has prepared a bill for the creation of a type of ‘parole board’ that would examine the cases of inmates serving life sentences and others serving long-term sentences. The board will look at each inmate’s case and decide whether to propose their release based on specific criteria, one of them being they have already served a significant part of their sentence.

Attorney-general Petros Clerides told state radio yesterday that the bill would soon be submitted to Cabinet for approval and then to Parliament. Clerides noted that up until this point, a life sentence means life, and the inmate must serve time until the end of his life.

Lifer Panayiotis Agapiou Panayis, alias Kafkaris, failed last month in his quest to end his ‘indefinite’ detention and redefine the terms of ‘life sentence’ in Cyprus.

Kafkaris was found guilty in 1989 on three counts of premeditated murder after planting and detonating a bomb in a car, which killed all three passengers, a man and his two young children aged 11 and 13.

He is currently serving a mandatory life sentence in Nicosia Central Prison. He applied to the European Court of Human Rights (ECHR) in 2004 arguing that changes in prison regulations and domestic law meant that his prison sentence was retroactively increased from 20 years to an indefinite period.

The ECHR found the Cyprus Republic guilty of creating legal confusion over the meaning of life sentences but failed to back the applicant on his quest to end his life sentence.

Following that case, Clerides noted that the Legal Service was moving to adopt legislation which would give the chance to lifers to have the right of release as long as certain conditions were met and a number of years had already been served.
