Retroactive retirement changes for teachers shelved

A PROPOSAL for retroactive implementation of a law that extended teachers’ retirement age to 63 was yesterday withdrawn by DIKO MP Athena Kyriakidou after it was deemed unconstitutional by the Attorney-general.
The decision will be welcomed by hundreds of students and young graduates, who have vehemently opposed the law that offers teachers the right to retire at the age of 63, instead of 60 and even more so, Kyriakidou’s proposal for this to start from this academic year instead of September 2011.
“The Attorney-general says there will be unequal treatment if this proposal is passed and in he feels the specific law is in contrast to Chapter 28 of the Constitution, which refers to the principle of good faith and good administration,” said Education Committee Chairman DISY’s Nicos Tornaritis.
The AG advised that if the law was to be implemented retroactively from September 1, 2010, instead of September 1, 2011, it would affect 185 teachers who were appointed in September this year and who enjoy the same benefits as the rest of the approximate 5,500 public teachers.
It would also affect some 183 teachers who are estimated to be appointed in 2011.
“We said from the start that depending on the Attorney-general’s advice, we will make our decision,” said Tornaritis. “So DISY cannot support an unconstitutional proposal.”
AKEL’s Yiannos Lamaris, whose party has opposed the law as well as DIKO’s proposal from the start, said he was pleased Kyriakidou’s suggestion had been deemed unconstitutional.
“We are happy that the proposal’s constitutionality has been clarified and that the retroactive implementation was deemed unconstitutional. I think it confirms our position that it would have imposed further injustices,” he said.
